Hosting of health data is regulated under French law by the French Public Health Code (Article L.1111-8), which stipulates that any healthcare organization—hospitals, pharmaceutical companies, laboratories—that handles personal medical data must use a service provider that is HDS-certified. 

HDS certification mandates that service providers establish safeguards to ensure the security, confidentiality, and accessibility of personal health data for patients. These safeguards encompass stringent authentication and authorization processes, resilient backup systems, and effective encryption techniques.

The DiGA framework, originating as the overarching compliance framework for reimbursement in healthcare applications in Germany, is expected to be adopted more widely across other countries in Europe towards the future. 

It encompasses multiple recommendations and certification tracks such as the Digital Care Act (DGV), Digital Health Applications Ordinance (DiGAV), and the Technical Guideline BSI TR-03161: Security Requirements for Digital Health Applications.

Encryption is mandated by various regulations, ensuring the secure processing and protection of sensitive health data in German digital health applications. You can find it for example as mandatory component of The Fast Track Process for Digital Health Application according to Section 139e SGB V.
